The following extract from DSS Guidance note 2/97 relates -

5.2   Highway Authorities ... have a duty to keep access over private land to which the public has a right of passage free from Obstruction, to maintain its surface and ensure that these routes are free from Obstruction, and ensure that these routes are properly signposted.  In fulfilling these duties, Highway authorities are providing a service to the public and will therefore have to ensure that they do not treat disabled people less favourably than others
